The book "Maxey's of Virginia" by Edith Clark shows that Walter Maxey, Sr. was married to a "Mary" unknown. Also noted in the family line of Walter Maxey, Sr. there is no listing for a middle name.

WALTER MAXEY, a son of Edward and Susannah (Gaites) Maxey had no original patent land of his own but, by the terms of his father's will, received after the death of his mother of the Virginia plantation on which they lived in Goochland County (later Cumberland County). In 1748 his brother Sylvanus, who had moved to Albermarle County, Virginia deeded the remaining 200 acres of the patent to Walter. He lived on this land until December 10, 1762 when it was sold to Creed Haskins for 390 pounds.

Walter then moved with his family to that part of Bedford County, Virginia which in 1785 became the county of Franklin. The terrain in this area of Virginia is quite different from the original Maxey settlement on relatively flat country west of Richmond, the former being rocky and mountainous and quite verdant, reminding one of the Welsh countryside. Walter purchased from Samuel and Grizel Smith 528 acres on the west side fo the Staunton River and the north side of the Blackwater River for 420 pounds in two separate transactions on August 20, 1763.

Walter was the last surviving child of Edward and Susannah and without question left the largest number of descendants, many of whom still reside in the area. On May 8, 1798, seven years after the death of Walter and right after the death of his wife, Mary, a suit was brought into court by the children and heirs of Walter in order that a commissioner be appointed to dispose of 130 acres on the Staunton River owned by Walter at his death.

Walter Maxey, a son of Edward and Susannah (?Gates) Maxey, was first located in 1738 as a tithable on Major Mayo's list of those living above Flat Creek in Amelia County, Va. He had no original patent land of his own, but by the terms of his father's will he received after the death of his mother one-half of the Virginia plantation on which they lived in Goochland County (later Cumberland County). In 1748 his brother Sylvanus, who had moved over to Albemarle County, Virginia, deeded the remaining 200 acres of the patent to Walter. His name has been found in incomplete tithe lists for 1758 and 1759 in Thomas Wooldridge's Precinct in Cumberland County. Walter lived on his land until 10 December 1762 when it was sold to Creed Haskins for ?390.

Walter then moved with his family to that part of Bedford County, Virginia, which in 1785 became Franklin County. The terrain in that area of Virginia is quite different from the original Maxey settlement on relatively flat country west of Richmond, it being rocky and mountainous and quite verdant, reminding the compiler of the Welsh countryside. Walter purchased from Samuel and Grizel Smith 528 acres on the west side of the Staunton River and the north side of the Blackwater River for which he paid ?420 in two separate transactions on 20 August 1763.

His move from Cumberland County may have been occasioned by his rancor at county court findings bringing his honor into question. A trial that had begun on 28 June 1762, when a grand jury examined a register in Walter's family Bible showing that his son Walter, Jr., was born 6 July 1745, concluded at the August court when he was fined 50 pounds of tobacco for the use of Southam Parish for concealing a tithable---namely his son who was beyond the taxable age of 16. Present at the court was an attorney for the King, and although Walter protested the charges, he was unwilling to contend with his Majesty, thus putting himself at the mercy of the court. He also had to pay the court costs. Peter Bondurant and his wife Amy appeared as witnesses for the King in August 1762, and they were paid for traveling 25 miles from their residence.

Walter was the last surviving child of Edward and Susannah and without question left the largest number of descendants, many of whom still reside in the area. The original copy of his will as well as other records relating to the probate of his estate are still on file at the courthouse in Rocky Mount. The children named were

On 8 May 1798, seven years after the death of Walter, and perhaps right after his widow's decease, a suit was brought into court by the children and heirs of Walter for the purpose of appointing commissioners to dispose of 130 acres on the Staunton River owned by Walter at his death. A settlement of Walter's estate was further complicated by the fact that Josiah, a son, had died two years after his father, leaving a large family. In 1799 commissioners appointed by the court---Jeremiah Maxey, John Craghead (husband of Jane Maxey), and Thomas Kemp (husband of EsterMaxey)---sold the above 130 acres to Thomas Leftwich for ?400, and the proceeds were then distributed to the heirs.

We have found nothing to corroborate some earlier genealogists' claims that Walter had more than one wife. We note that the name of his wife in1763 (when she relinquished her right of dower to the land in CumberlandCounty) was Mary; that was also the name of his wife when he wrote his will in 1791.

The following letter by the late Mae A. Maxey of Vinton, Virginia,appeared in the Maxey Family Reunion Bulletin in 1961:

"The Maxey Cemetery containing the [unmarked] graves of Walter Maxey, Sr., who died in 1791 and near kin . . .is located on the old Maxey plantation on a sloping hillside overlooking Blackwater River in Franklin County,Virginia. Their remains are to be removed and reinterred on a plot at Mt. Ivy Baptist Church* which is a very fitting location as it is in the general vicinity in which they lived and died and also more accessible to travel. Their peaceful slumbers are being interrupted by the rising waters of Smith Mountain Lake formed by a dam that is being constructed a few miles below by Appalachian Power Company. All expense of plot removal and reinterment is being taken care of by the Power Company. Descendants of this brave and courageous tribe of Maxeys are scattered in many states now and a few in foreign countries."

Walter Maxey, son of Edward and Susannah, was born in Virginia. By his
father's will he received, after his mother's death, half of the land on which they lived in Goochland County, Virginia. This part of Goochland later became part of Cumberland County. There is a deed dated 12 April 1748 in Goochland County, Book 5/400-401 by which his brother, Silvanus, conveyed to Walter the remaining 200 acres of land.   • Walter Maxey, son of Edward and Susannah, the last surviving child, left a will which a copy and other records related to the probate of his estate, are still on file at Rocky Mount Courthouse. Mae A. Maxey indicated in a letter that the grave of Walter Maxey, Sr. who died 1791 and his 'near kin' were located on the old Maxey plantation. Their remains were removed and reinterred on a plot at Mt. Ivy Baptist Church, many having no headstone. Facing the headstone of William H. Maxey, about five degrees to the left, the back corner of the cemetery is the plot in which the plantation graves were reinterred.
