Sir Henry Frederick Howard, 22nd Earl of Arundel

Sir Henry Frederick Howard, 22nd Earl of Arundel was born on 15 August 1608.1 He was the son of Sir Thomas Howard, 21st Earl of Arundel and Lady Alethea Talbot.1 He married Lady Elizabeth Stuart, daughter of Esmé Stuart, 3rd Duke of Lennox and Katherine Clifton, Baroness Clifton (of Leighton Bromswold), on 7 March 1625/26.1 He died on 17 April 1652 at age 43 at Arundel House, The Strand, London, England.1 He was buried at Arundel Castle, Arundel, Sussex, England.1

Sir Henry Frederick Howard, 22nd Earl of Arundel gained the title of Earl of Surrey. He was invested as a Knight, Order of the Bath (K.B.) on 4 November 1616.1 He held the office of Member of Parliament (M.P.) for Arundel from 1628 to 1629.1 He held the office of Member of Parliament (M.P.) for Callan [Ireland] in 1634.1 He was invested as a Privy Counsellor (P.C.) [Ireland] on 10 August 1634.1 He held the office of Member of Parliament (M.P.) for Arundel in 1640.1 He succeeded to the title of Lord Mowbray on 13 April 1640.1,2 He fought in the Battle of Edgehill.1 He graduated from Oxford University on 1 November 1642 with the degree of Master of Arts (M.A.).1 He succeeded to the title of 22nd Earl of Arundel [E., c. 1138] on 4 October 1646.1 In 1648 he was fined £6,000 by Parliament, but allowed to compound for his estates.

Note that some genealogical sources describe Henry Frederick Howard as the 25th Earl of Arundel. It is not clear where this discrepancy comes from.

Henry Frederick Howard, 15th Earl of Arundel PC (15 August 1608 – 17 April 1652), styled Lord Maltravers until 1640, and Baron Mowbray from 1640 until 1652, was an English nobleman, chiefly remembered for his role in the development of the rule against perpetuities.

Henry sought to control the succession to his property after his death. Toward that end, he placed in his will a shifting executory limitation so that title to some property would pass to his eldest son (who was mentally deficient) and then to his second son, and title to other property would pass to his second son, and then to his fourth son. The estate plan also included provisions for shifting the titles many generations later if certain conditions should occur.

When his second son, Henry, succeeded to the elder brother's property, he did not want to pass the other property to his younger brother, Charles. Charles sued to enforce his interest, and the court (in this instance, the House of Lords) held that such a shifting condition could not exist indefinitely. The judges believed that tying up property too long beyond the lives of people living at the time was wrong, although the exact period was not determined for another 150 years.
