  • This 30 day of January in the year of our Lord 1759, I John Bearse of the Town and County of Barnstable in the Province of the Massachusetts Bay in New England, Yeoman being very sick and weak in body but of perfect mind and memory thanks be given to God therefore calling unto mind the mortality of my body and knowing that it is appointed for all men once to dye do make and ordain this my last Will and Testament that is to say principally and first of all I give and recommend my soul into the hands of God that gave it and for my body commend it to the Earth to be buried in a Christian like and descent manner at the discretion of my Executors or Executrix, nothing but at the general resurrection I shall receive the same again by the might power of God and as touching such Worldly Estate wherewith it hath pleased God to bless me in this Life. I give Demise and dispose of the same in the following manner and form[:]
  • Imprimis my will is that all my just debts personal charges and Legacies be all Equally paid by my two daughters Mary Bearse and Dinah Bearse in a Convenient time after my decease.
  • Item I give and bequeath unto Eleanor Bearse my dearly beloved wife my best cow and one third of all my household goods and one third of all my grain and one third of all my provisions and the use of one third of my dwelling house and one third of my barn and the use of all my real estate (excepting what I have hereafter given to my son John and his sisters) so long as she lives my widow and that I give her in lieu of her Dower.
  • Item I give and bequeath unto my son John Bearse Jun and to the heirs of his body the house that he now lives in and all the Land that he ow lives upon that I bought of Gideon Hathaway being about thirty acres more or less with a small barn standing on said land and the field that lyes to the south and of his house bounded as the fence now stands all round it being about Six or Seven Acres and also that part of the Rye field (so called) that I bough of Joseph Bearse be it more or less and also the whole of my piece of meadow adjoining to Josiah Stamblems meadow called the hill meadow and also a piece of woodland at a place called the fesh[?] holes [that] I bought of Benja: Beauce have Decead;
  • Item I give to my son John Bearse Jun all my wearing apparell my armour and one quarter of my cart and wheels.
  • Item I give and bequeath unto my three daughters equally viz Hannah Bearse Mary Bearse and Dinah Bearse & to their respective heirs and assigns forever all my buildings both my dwelling house and barn and all my Real Estate that I have not before given to my son & lying and being in the Township of Barnstable and elsewhere both upland and meadow preserving the Improvement as above mentioned to their mother.
  • Item I give to my three daughters equally and to their heirs my Daughters above named viz two thirds of all my household goods and two thirds of my grain and two thirds of all my provisions and three quarters of my grain and two thirds of all my Provisions and three quarters of my cart and wheels and all my plowshoer Chain *all other my Husbandry Tools.
  • Item I give and bequeath unto my two Daughters Hannah Bearse and Dinah Bease my Looms and lathing.
  • Item I give unto my Daughter Lydia Callio six shillings.
  • Item I give unto my Daughter Eleanor Logge twenty shillings & two of my sheep.
  • Item I give unto my Daughter Martha Lewis twenty shillings.
  • Item I give unto my Daughter Mary Bearse and Dinah Bearse the better to enable them to pay all my last debts due to me and all other personal Estate not before in this my Will disposed off.
  • Lastly, I constitute make and ordain my two Daughters Namely Mary Bearse & Dinah Bearse my only & sole Executors or Executrixs of this my last will and testament and do hereby utterly disallow revoke and disanull all and every other former Testaments Wills and Legacies & Exauss by me in any way before this time named willed & bequeathed Ratifying & Conferming this & as other to be my last Will and Testament In witness

    • LS know ye that on the fifteenth day of May Anno Domini * bothe J**st**ment hereunto annexed (purporting the Last Will and Testament of John Bearse late of Barnstable in said County yeoman deceasd) was presented for Probate by Mary Bearse and Dinah Bearse the Executors therein named Then present Solomon Otis Esq Lott Gage & James Hathaway Wittnesses—thereunto subscribed who made Oath that they say the said Testator Sign, seal and heard him declare he said Instrument to be his Last Will and Testament and that they Subscribed their names togeather as Wittnesses to the Execution thereof in the said Testators Presence and that I do approve and allow of the said Instrument as the Last Will and Testament of the before named deceased and do Committ the administration thereof in all matters the same concerning and of his Estate whereof hede**erd and *o*ert in said County unto Mary and Dinah Bearse ye before named Executors well and faithfully to execute the said will and to adminisr: the Estate of the said Debts according thereto who Accepted of their said Trust and to Exhibit and Inventory of the Estate of Said deceased according to Law and they shall Render on August (upon Oath)of their proceeding.
