Bazil inherited considerable property from his father and apparently was a poor manager or a victim of circumstances. He sold property on 14 Mar 1746 in Prince George's Co. at the request of John Brashear Sr. in order to settle a £200 debt. He deeded 62 acres of Cuckolds Delight, 80 acres of Glennin, 95 acres of Letchwich and another 19 acres to John Brashear. Moses Ball and Phillip Brashear served as witness to this transaction.

Basil and Ann moved to Granville Co., NC where he was living on 30 May 1749 when he bought 422 acres on Jonathans Creek. He later bought land in Orange Co., NC on Reedy Fork. In 1761, Robert Brashears purchased land on Reedy Fork of Haw River that was contiguous to land owned by Bazil. Bazil continued to be a poor manager of money. In March, 1754 he confessed a debt to John Boyd and was ordered to pay him in Virginia money. Court records reveal court decisions regarding Basil and his debts for many years. He sometimes did not appear in court as ordered.

Named after Ann's brother Middleton. Middleton's name is connected to numerous land transactions during the 1760's in Orange Co., NC. Some of the transactions refer to the land being on Reedy Fork of Haw River joining Jesse Brashear. The land involved in the transactions would, for the most part, be in the northeast part of present-day Guilford Co. Middleton Brashear, like his father, is also named in numerous court decisions in Orange Co. Middleton's cases were different in that he was suing others for payment of debt instead of being sued. Middleton Belt's will in 1745 gave a horse to "my nephew Middleton Brashear, son of Basil Brashear". (Prince George's Co., MD Wills)Name appears in numerous land transactions in Orange Co, NC. He most definitely DID NOT marry Sarah Wallingsford, who m. Basil double cousin, William Brashear "Senior", s/o Benjamin Brashear Sr and Mary Jones. The Maryland Calender of Wills simply misinterpreted both Benjamin Wallingsford's will and Sarah Wallingsford's will. Basil, indeed, was a debtor to the estate, but the estate papers are quite explicit: to William Brashear, in right of his wife, Sarah, formerly Wallingsford.

BASIL BRASHEAR and ANN BELT#288. Basil Brashear, b. 1714, Maryland, s/o Samuel Brashear Sr, the Maryland Carpenter, and Ann Jones; m. cl735, PGCo, Ann Belt, d/o Benjamin Belt and. Elizabeth Middleton. We know from tax and court records that they had several children, but (at present) we can document only two.

Documented children of Basil Brashears and Ann Belt: 701. Middleton Brashears, b. c?1732-3, (21 or over when entering land in NC, 14 Jan 1754); identified as s/o Basil Brashears in the will of Middleton Belt, brother of Ann (Belt) Brashears, and in some North Carolina deeds. 702. Henrietta Brashears, b. c?1740; m. (4th wife of) Philip Prather, d. 1767, Enoree, Laurens Co, SC. The citation granted "Henereta" Prather and Middleton Brashear on 24 Sep 1767, to administer on the Estate and Effects of Philip Prather, late of Enoree, Planter, deed, identifies Henrietta as the widow and Middleton Brashear as a brother-in-law of Philip Prather (Brent H. Holcomb, Probate Records of South Carolina,v.3, p.45), which means that either Middleton married a sister of Philip Prather, or Henrietta was a Brashear. Since Philip's sisters were all about 30 years older than Middleton (b. 1703, 1705), I'm concluding that Henrietta was a d/o Basil, who had married a very old Philip Prather.

Probable (undocumented) children of Basil Brashear and Ann Belt: 703. Robert Brashears, d. 1810, Knox Co, TN, naming daughter, Martha Morrow of Mecklenburg Co, TN, in his will. This Robert ?may be the ancestor of some of the Scott Co, TN, Breshears, whose descendants use names that run in Basil's family: Isaac, William, Robert, Jeremiah, Alexander, Martha, Keziah, Naomi, Maty, Ruth, etc. 704. William Brashears, b. 5 Oct 1741 (age 79 on 5 Oct 1820, when applying for Rev. War pension, in Maury Co, TN) (frequently Bratcher in Spartanburg Co, SC land and court records, also Bracher and Bradshaw); m. Stimh . On Rowan Co, NC, tax lists in 1772; lived Spartangburg, SC after cl776. Evidence suggests he had at least sons, William Brashears,b. 1770, and Ithra Brashears, b. 1780. 705. Isaiah Brashears, enlisted 25 Mar 1776, in Fifth Regt, ?Spartanburg Co, SC. This is possibly the Isaiah Brashear who was briefly cl805 with the Robert Samuel Brashear colony in Roane Co, TN. 706. Jeremiah Brashears, b. bef 1751 (over 21 when on 1772 Tax list. Rowan Co, NC); m. Elizabeth . "Jeremiah" runs in both the Belt and Brashears families as a given name. Jeremiah and Elizabeth lived on the Tygar River in Spartanburg Co, SC. His children apparently moved to Christian and Hopkins Co, KY, and spelled their surname Beshears. 707. Basil Brashears, possibly b. 1752 in Guilford Co, NC (TN Cousins), also in Rosine Co, TN, records. 708. On 11 Feb 1791, Benjamin Bratcher, of Spartanburg Co, SC, bought, for £50 Sterling, 100 acres on East side of branch of Richland Creek, part of a grantto Thomas Hatteway, from John Conner and wife, Winifred, of Franklin Co, GA. The Will of Middleton Belt (PGCo, 1745), reads, in part: I, Middleton Belt, of Prince Georges Co, MD, ... to my nephew, Middleton Brashears,son of Basil Brashears, at the decease of my father, Benjamin Belt, one slave ... Witnesses: George Wills and John Brashears; Feb 25, 1745,probate 21 May 1746. The John Brashears who was a witness to Middleton Belt's will was probably John Brashears the third (s/o Samuel Brashear Jr), as might be suggested by this deed: PGCo Land records. Book BB#1, p.385 (29 Aug 1745): At the request of Basel Brashears the following deed was recorded, September, the sixteenth day. Anno domini Seventeen hundred forty five: The Indenture made this 29th day of August in the year of our Lord God One thousand seven hundred and forty five between John Brashears the third of Prince George County in the province of Maryland, Planter, of the one part and Middleton Brashears of the said county of the aforesaid province, minor, of the other part—Witnesseth that the said John Brashears the third out of the love and affection that he hath and doth bear unto the said Middleton Brashear and for diverse other causes and considerations here unto more hopefully moving hath given granted ... unto the said Middleton Brashears One Bay horse about thirteen and a half hands and branded on the off thy thus .... Early Debts Basil also had his troubles with debt: Basil Brashears to George Scoll(Sheriff), 16 Mar 1740. Basil deeds to Scoll "two negro wenches, named and Sarah, and all their increase," to discharge a debt of £5.6.3. (PGCo. Land Records Book Y, p.260) He brought suit against Samuel Richards in 1742, and then didn't appear in court. MdHR Judgments, (Anne Arundel Co), Bk ? p?, 9 Nov 1742 Basil Brashear ) vs ) Samuel Richards )Command was given to the Sheriff of Ann Arundel Co. that he should take Samuel Richards late of AA, Innholder, if he should be found in his bailiwick and him should safe keep so that he might have his body before his lordship's Justices of the Ann Arundel Court to be held at Annapolis the second Tuesday of November, then next to answer unto Basil Brashears of a plea of trespass upon the case...[At next session, Samuel Smith, Sheriff, presented Richards, as directed. Also one Edward Rookesby offered his bond to assure the conduct and pa5nnent by Richards, should he be convicted.]Thereupon the Prayer of the said Samuel Richards by Joshua Hopkinson, his attorney, the said Basil Brashear is adjudged to give security forcost in case he shall be nonsuited in the plea aforesaid, but the said Basil Brasher alltho solemnly called comes not but makes default, nor does he further prosecute his writ in the plea afsd against the saidSamuel Richards.THEREFORE, it is considered by the Justices here the 9th day of November, Anno Dom. 1742, afsd that the Said Basil Brashear take nothing by his writ afsd, but that he and his pledges of prosecuting by in Mercy and that the names of the pledges by sought for, etc. And that the afsd Samuel Richards go thereof without Day. And it is also considered that the afsd Samuel Richards recover against the said Basil Brashear the sum of Two hundred and thirty-one pounds of Tobacco by the court here unto him on his assent adjudged for hiscosts and charges by him about his defence in this behalf laid out andexpended and that he have thereof his Execution against the said Basil Brashear according to the form of the Statutes, etc. Basil Brashears to Samuel Brashears [Jr], 2 Jun 1744, Bill of Sale. Atthe request of Samuel Brashears, the following Bill of Sale was recorded 2 Jun 1744:Basil sells (no mention of money; so Basil probably owed Samuel money) one horse called Jolly, branded on the near buttock one black mare called Indian, branded on the near shoulder & buttock one mare call Fly, branded on each thigh and a horse colt One bay mare called Phillis, branded on the near shoulderone cow and calf marked with a crop and two slits in the left ear and an underbit in the right... Basil Jumps Bail Basil was released from debtors prison apparently in 1746 and "bound" to certain men [justices] in Upper Marlboro to work off his debts. From The Maryland Gazette, Tues, 28 Apr 1747: "John Cooke, Joseph Belt Jr, and John Heiibum, all of Upper Marlborough, report a runaway servant, Basil Brashear, lately a prisoner in Prince George's County jail fordebt. He's a very good carpenter and has probably gone to Virginia." Apparently, Basil got his brother, John "Senior" to buy him out, and then Basil left Maryland. PGCo Deeds, Book EE, p.330: At the request of John Brashear Senr the following Bond was recorded:Know all men by these presents that I, Bazil Brashear of Prince Georges County in the province of Maryland, do stand and am fumly bound and obliged unto John Brashear Senr of the said County and province in thefull and Just sum of Two Hundred pounds current money of Maryland, towhich payment well and truly to be made and done 1 do hereby bind myself, my heirs, Exectrs and Adminrs firmly by these presents sealed with my sesd and Dated the 13th day of March, Anno Domini 1746/7.The CONDITION of the above obligation is such that if the above bound Bazil Brashear or his Heirs do well and truly make over and convey unto the said John Brashear his Heirs or Assigns by a Deed of Indenture of Special Warrantees part of "Cuckholds Delight," sixty-two acres, part of "Gleaning," eight acres, "Levings," nineteen acres, "Letchworth,"ninety-five acres for and in consideration of one hundred pounds paidto him in hand without fraude or ?Covin, then the above obligation tobe void and of none effect, otherwise to remain in full force and power and Virtue in Law. Signed Sealed 6b Delivered In the Presents of us Baz Brashear (Seal) Moses Ball, Phillip Brashers[NOTE: The use of these witnesses would suggest that this instrument was made in Fairfax Co, VA, where Bazil's brother, Robert C. Brashear, had moved in 1742 after his bout with debt in PGCo. Moses Ball was husband of Ann Brashear, RGB's daughter,^ and Philip was RGB's oldest son; from 1742 to cl746, RGB and family lived in Truro Parish, Fairfax Go, VA. Note also that John Brashear, s/o John, was forced to divide "Cuckhold's Delight," "Gleaning," and "Leavings" with Gov. Benedict Calvert, to satisfy his debts to the Gov. (see previous chapter)

Migration to North Carolina Basil led the migration to North Carolina, as early as 1747; his brothers Otho and Robert C. Brashear were his neighbors in northeastern Guilford Co by 1753. Other neighbors included Middleton Brashear, s/o Basil, and Jesse and Robert Samuel Brashears, sons of RCB. Loose papers found recently indicate that Bazil Brashear was issued awarrant for 640 acres on the south side of Haw River in Orange County (now Guilford Go) North Carolina, beginning against the Piney Sholes. Entered 14 Jan 1754; warrant issued 17 Apr 1754; surveyed 12 Nov 1754;transferred to his son, Middleton Brashear, deed dated 3 Feb 1761. Bennet; publ 1987.)Middleton received two land grants in Orange/Guilford, NC, in 1760's; one in his own right, one by assignment from his father, Basil.
