The Question of Identity

The identity of Agnes Maxwell's father has not been satisfactorily established. The late James MacFarlane identified Agnes as the daughter of Sir Patrick Maxwell of Newark, History of Clan MacFarlane: 62 but it is impossible to say who her father was, because the only knight of this name in the family cannot have been born any earlier than about 1610, forty-six years or so after Agnes is reported to have married Andrew MacFarlane of Arrochar. Stirnet disagrees with James MacFarlane, suggesting instead that she was "probably" the daughter of George Maxwell of Newark, who died in November 1585. Stirnet: Maxwell 04

Marriage

According to the late James MacFarlane, Author of The Red Fox, Andrew MacFarlane of Arrochar married before, or about 18 March 1564: "Agnes, daughter of Sir Patrick Maxwell of Newark, by whom he had three sons and one daughter, John, who succeeded him, George, who received for his patrimony the Mains of Kilmaronock (the castle still stands), but left no succession, Humphrey of Brackearn, and Elizabeth, who married Malcolm MacFarlane of Gartartan." The name of Agnes Maxwell's mother is not identified by James MacFarlane. History of Clan MacFarlane: 62

23 November 1619: Letters of horning William Lord Kilmaurs against James Earl of Glencairn his father, Sir John Buchanan of that ilk knight and William Barclay of Innergelly, proceeding upon a narrative that the Earl as principal and Sir John Buchanan and William Barclay as cautioners by their bond and obligation dated at Kilmarnock and Edinburgh the 8th and 11th June 1618, mentioning that the lands and barony of Kilmarnock at least certain annualrents upliftable therefrom were wadset to umquhile Andrew Macfarline of Arrochar and Agnes Maxwell his wife in liferent, and Humphrey, Robert George and (blank) Macfarlanes their sons in fee; Redeemable and under four several reversions containing the sum of 1400 merks and another annualrent was annallied from the said lands to [ ] Buchanan of Cameron redeemable for 300 merks, obliged them conjunctly and severally to have redeemed the said wadsets from the persons having right thereto and to have delivered sufficient discharges thereof to the said William Lord Kilmaurs as heritable fiar of the said barony between the date of the said obligation and 11 November 1619 then past, but which they delayed to do etc. Signet 3rd December 1619.
