IN THE NAME OF GOD, AMEN.
I, Richard Womack of the County of Rowan and State of North Carolina (farmer) being weak of body, but of perfect mind and memory, Thanks be to God for the same and calling to mind the mortality of my body and knowing that it is appointed unto all men once to die do hereby make and constitute this my last will and testament, touching my worldly Estate, Viz-I give, devise, and dispose of in the manner following, to wit,
First, I commit my soul to the care of almighty God who first give it to me, and my body to the dust from when it was first taken, the same to be buried in a decent manner-
Secondly, I will and devise that all my Just debts be paid.
Thirdly, I will and bequeath unto my dearly beloved wife, Ruth Womack, the Land and plantation whereon I now live, to be at her will and disposal during her natural life or widowhood, and also, her choice of my Horse creatures and the two choice Cow kine, and my waggon and hind Gears with all their necessary apparatus-and as many of my Hogs as she pleases to keep-with a bear shear plow, and a shovel plow, her choice axs, and weeding hoe-together with as many other plantation and farming working tools and utensils as she may be considered to stand in need of, and also her choice bed and bedstead with a sufficiency of furniture to the same, together with as much of the other household, and kitchen furniture as she may wish to retain to housekeep with, and I wish and desire that at the death of my said wife Ruth Womack, that all the aforesaid property willed, to her to be sold and equally divided amongst my surviving children, or their lawful and bodily heirs.
Item: I also bequeath unto my wife all my present crop now on hand together with my fattening hogs now a fattening to the use of herself and my three daughters, Nancy, Rebecca and Agnes Womack.
Item: I give and bequeath unto my son James or his heirs, Forty four Pounds Eleven Shillings, which he has formerly received (together with a Tract of Land containing per Deed two hundred acres, which I have already Deeded) The same to be his full share proportion or part of my Estate.
Item: I give and bequeath unto my daughter Sally Hodge, thirty eight pounds, six Shillings, which amount she hath already formerly received.
Item: I give and bequeath unto my son Daniel Womack, forty nine pounds, nine Shillings already received.
Item: I give and bequeath unto my son Hezekiah Womack, twenty six pounds, already received.
Item: I give and bequeath unto my daughter Edith Owen, eighty six dollars and fifty seven cents, already received.
Item: I give and bequeath unto my son Josiah Womack, one horse colt, two years old next spring, priced at forty dollars with a saddle priced at fifteen dollars in part of his legacy of my Estate.
Item: I further give and bequeath unto my son Hezekiah Womack one bed and furniture priced at thirty dollars, one cow and calf priced at ten dollars, the same to be accounted towards his Legacy of my Estate.
Item: I will and devise that the three remaining children, Viz, Nancy Womack, Rebecca Womack, and Agnes Womack become equal shares with the rest of my aforesaid children (James Womack excepted) and that there may be an equal distribution of my Estate among my several Heirs as heretofore expressed, and that the several amounts above received be all and severally considered as part or parts of my Estate, and that those who received nothing, and those who have received the lesser shares shall receive a proportionate part with those who may have received the greater part and that my whole children or their lawful bodily heirs have an equal division of my Estate.
Item: I will and desire that my son Daniel Womack and my son-in-law John Hodge act as Executors on this my last will and testament and for their services receive a Just and due recompensation IN WITNESS whereof I declare this to be my last will and testament renouncing all others by me heretofore made. This the Sixteenth day of December One Thousand Eight Hundred and Twenty.
